Converting a Frame Sequence to DnxHd

I am trying to convert a dpx sequence to a dnxhd mov.

I've tried the following command:

rvio frames.#.dpx -outfps 23.976 -outdatarate 36000000 -codec AVdn -outres 1920 1080 -o clip.mov

The quicktime is created as a dnxhd but the data rate is not changing.  No matter what value I enter for outdatarate the rate stays the same.
When i view the movie info it in quicktime says the data rate: 177.78 mbits/sec as opposed to 36 mbits/sec.

Any thoughts?  Thanks.

    Has this issue been resolved or any new information for this? I have the same issue regardless of outdatarate it read when I opent the DNxHD

    176.16 mbits/sec and I need 36 mbits/sec. Any follow up or help would be greatly, greatly appreciated.

    I am only asking because the only response is from 2012..soooo yeah.

    Hi Guys (and all other readers),

    We are not licensed to support Avid's patented DNxHD VC3 implementation. The added cost of becoming licensed would be significant, reoccurring, and only applicable to a small number of our users. It is not currently in our plans. Please contact us in a private ticket if you want to discuss things further.
